Stop Union Bullying Campaigns
Recently the Local Painters Union, District Council 9 and Local 711, have attacked Alpine Painting by mounting
a Union Smear Campaign against our Family Business.

The question remains “Why Are They Doing This?”

We believe that these Local Labor Unions have recognized Alpine Painting as one of the top Commercial and Industrial Painting Contractors in the NJ & NY Area.  Both Labor Unions tried for years to Sign our Firm to their Local.  When Alpine Painting expressed it wasn't in our company’s best interest to join them they started this abusive multi-level attack. 

John Foy, (Director of Business Development for NJ Labor Union DC 711) and John Drew, (NY DC 9 Painters Union Member) have sent numerous letters to our customers stating that we are an unscrupulous contractor, that Alpine Painting is Underpaying our workers or Not Paying Areas Standard Wages and that we may be Cheating the Government and our Customers.  The DC9 Painters Union created a Website to degrade our Name hosting pictures of Crooks Running off with Bags of Money, A Knife in the Back of a Working Person and Boots Stomping on a Family Sitting at the Dinner Table.

The local labor unions have used bullying tactics to intimidate us and to mislead the public about our business practices.  This type of campaign is not an isolated attack on Alpine Painting alone.  This is part of a national trend by organized labor to regain lost market share in the construction, manufacturing and service industries.

The union allege in their slogans and publications that Alpine “Violated the Law,” is an “Unscrupulous Painting Contractor” and “Cheated the Government and their Workers”. Nothing could be further from the truth! Alpine Painting & Sandblasting Contractors has been in business since 1975 and is in good standing with all regulatory agencies and our customers. Our business practices get audited annually by various regulatory agencies and the largest painters association in the United States of America, the Society of Protective Coatings (SSPC).
You may have read that Alpine violated Section 220 of the New York State Labor Law on a project in 2008/2009 (Case # PW112009006892), but what you won’ tread in the union propaganda is that Alpine paid all of its workers according to the local Painter prevailing wage rate, for that project, for every hour that they worked! You may ask yourself, why is Alpine in violation of the Labor Law? That is a good question and one that has a reasonable answer.

Background:
Several painter wage rates existed at the time that project took place. One was the “Painter (Sandblaster-Painter)” rate and the other was the “Painter (Bridge & Structural Steel)” rate. Upon review of the published prevailing wage information at the time of the project, the Painter (Bridge & Structural Steel) rate description used the wording, “…without the support of solid scaffolding” to illustrate when someone should classify something as structural steel. During this project we used full supported scaffold to access this elevated pipeline, so it was clearly not structural steel, according to the NYDOL description. Since the word “Bridge” was never used in the contract or by the owner to describe the elevated pipeline, we felt as though the proper rate to be paid was the “Painter (Sandblaster-Painter)” rate (Please see… http://www.alpinepainting.com/casestudies/rockland_county_sewer_district_no._1_pipelines_nanuet_ny_and_blauvelt_ny for a case study with photos and videos of the project in question, for which Alpine won two national awards. Near the end of the project the painters union’s business agent arrived on site and was very upset that Alpine, an open/merit shop contractor, was performing painting work on this project. Upon investigation of our certified payroll reports, the union filed a grievance with the NY State Department of Labor against Alpine for improper payment of prevailing wages on this project. The union claimed that the elevated pipeline was a bridge and the higher “Painter (Bridge & Structural Steel)” wage rate should have been paid.

Dispute:
The NY State Department of Labor (NYDOL) agreed with the union and directed Alpine to pay the higher wage to its employees plus interest and penalties. Alpine and its attorney did not agree with the determination and felt as though we had a good case to challenge the determination of the Department of Labor. During meetings with the NYDOL, Alpine claimed that the only published information in the prevailing wage description said that by utilizing supported scaffold the proper wage was paid. In addition, the title of the project was “Hackensack River / Nauraushaun Brook Siphon Rehabilitation” and was never referred to as a bridge. The NYDOL contended that their expert in classification of the prevailing wage laws, the union, contends that this elevated pipeline is a bridge. Since the burden was upon Alpine to prove the NYDOL wrong, we were not able to find sufficient evidence to convince the NYDOL to change their determination. Since the cost of litigation was becoming incredibly expensive and nearly double the amount of money was being held from Alpine on unrelated public contracts for nearly 3 years, we decided to concede to the NYDOL ruling and not pursue the matter in court. Unfortunately, since Alpine challenged the ruling of the NYDOL, the violation was classified as willful in the eyes of New York State Labor Law.

Resolution:
Since the NYDOL forced other public agencies to withhold payment from Alpine on unrelated projects, the State of New York paid the wages and interest to Alpine’s employees who worked on the project and kept the penalty payments. The rest of the money that the State withheld from Alpine for approximately 3 years, was paid to Alpine for work completed.

Questions:
 Does Alpine owe an outstanding $93,172.00 to the government and workers of our communities?
No, the government withheld that money from Alpine for approximately 3 years until the case was settled.
 Did Alpine willfully withhold payment from their employees?
No, Alpine paid the wage that it determined was correct at the time of the project.
 Did Alpine willfully cheat the government?
No, Alpine didn’t cheat anyone.
 Does Alpine agree with the NYDOL’s wage rate determination on that project?
No, Alpine does not agree with the NYDOL determination, but respects its authority.
 Does Alpine cheat their customers?
No, the Rockland County Sewer District #1 did not feel cheated on this project and we have performed several other projects for them since this one. They continue to be a great reference for Alpine Painting.
 Should Alpine’s existing and potential customers be badgered by the Painters Union with misleading claims about its business practices?
No, Alpine, nor its customers, have any interest in the union or their misleading claims. We pay our employees a fair wage and provide a fair price for work we perform for our customers.
 Does Alpine “cheat working men and women by destroying the living standards?”
No, Alpine pays its employees fair wages and complies with all Local, State and Federal regulations.
 Does Alpine have “an unfair advantage on being awarded public work jobs by underpaying their workers?”
No, Alpine pays the required wage on every public project it completes and submits certified payroll reports to confirm those payments.

NJ Star Ledger Featured Article: Find A Seasonal Job At Alpine

Alpine Painting and Sandblasting Contractors was featured on the front page of the New Jersey Star Ledger’s “Jobfinder” section. The article discusses the importance of seasonal jobs in the painting industry along with insightful quotes by Alpine’s Director of Operations and Safety, Sam Scaturro. Even during tough economic times Alpine constantly continues to grow and is always looking to hire new seasonal workers that are qualified to work in the field.

Much of the training for commercial painting is learned on the job by watching seasoned veterans. Additionally, three fourths of the training is about safety procedures in the shop. This training process can last over eight weeks before each individual is cleared for work in the field. All of Alpine’s seasonal employees must also undergo a drug test, background check, and hearing tests before they are hired.

While many seasonal jobs do not offer competitive pay, Alpine’s average seasonal worker is paid between $15-18 an hour. Four of Alpine’s seasonal workers earned over six figures. While Alpine strives to keep seasonal workers employed for as long as possible the harsh New Jersey winter months make it difficult to paint outside for part of the year.

Green Building Programs Forecast to Skyrocket: PaintSquare News

Space covered by green building certification programs will increase from 6 billion square feet worldwide in 2010 to 53 billion square feet by 2020, a new market forecast says.

About 80% of green-certified building space will be in the commercial building sector by 2020, up from 73% today, reports Pike Research, of Boulder, Colo.

For commercial space, most green certifications will go to existing buildings, rather than new construction. In contrast, most of the residential focus will be on green certification of new properties, the company forecasts.

Green building techniques are increasingly becoming the standard within the architecture and construction industries,” says research analyst Eric Bloom. “There are three major drivers behind green building certifications: environmental responsibility, reducing operating expenses through energy efficiency, and regulatory requirements that mandate energy efficiency and certifications.”

Green building certification programs are becoming increasingly important tools to verify that a building meets a set of “green” criteria, including energy efficiency, sustainable materials selection, site location and indoor environmental quality. In addition to their environmental benefits, certified green buildings can sometimes command higher property values and rents, and green building certification can distinguish certain properties in highly competitive real estate markets, Pike notes.

In addition to the well-known Leadership in Energy and Environmental Design (LEED) program in the United States and the Building Research Establishment Environmental Assessment Method (BREEAM) program in the United Kingdom, there are more than 20 established green building councils around the world, with more than 40 other national-scale groups seeking similar status in the next few years.

 While LEED and BREEAM will continue to dominate the North American and European green building markets, respectively, Pike Research anticipates that newly developed programs in China and India will represent about 30% of all certified green new construction by 2020.

Pike Research’s study, “Green Building Certification Programs,” analyzes the current market and regulatory conditions related to green building certification programs and provides forecasts for the growth of this industry.

 The report includes an examination of green building drivers, barriers, and likely shifts in the underlying construction market. It also features profiles of major industry players, including detailed descriptions of dozens of green building certification programs around the world. EPA and RRP's New Lead Safety Law

 So What's New?

          The EPA has put in place a  new lead-safety regulations that has been enforced as of April 22, 2010.  This action is in conjunction with the Renovation, Repair and Painting Program, (RRP) the EPA has provided a new set of comprehensive guidelines for contractors and property managers.  

Who do the rules apply to?
  • both interior and exterior painting and renovation projects at potential lead-based paint locations
  • houses, 
  • apartments,
  • child-occupied facilities such as schools and daycare centers built prior to 1978
Please Note:

          All painting firms must certified and each individual employee must be trained for lead-safe work practices.  Contractors must also provide the building owners with a new hazard pamphlet and post lead hazard signs around the property.  Finally, the EPA has mandated that contractors practice dust containment measures and follow waste disposal procedures.

Some EPA Exceptions

          There are also certain exceptions to the new safety regulations.  For example, if work includes only the application of paint and does not involve sanding, scraping, or other dust causing activities then the new RRP regulations do not apply.  Additionally small projects such as interior work that is less than six square feet of painted surfaces or less than 20 square feet of painted surfaces for exterior work do not apply. Furthermore, you can receive an exemption from the rules if the area has been declared free of all lead-based paint by a certified renovator that uses the EPA recognized test kit.

Marketing Internship Position Available - Social Media, Short Video Editing, Email Marketing Campaign


THE WORK

We are looking for an out of the box thinker to help drive our Internet Marketing Campaigns. This would include managing our many Social Media pages, organizing and coordinating our email marketing initiatives, updating our company blog sites, filming and editing short market and service video clips for our website, etc. Interns will gain experience working with a medium size service company dealing with many different aspects of day to day business operation.



THE COMMITMENT
Interns are required to work a minimum of 16 hours and a maximum of 35 hours per week for the duration of a summer semester. We expect each intern to possess a positive attitude and drive, to be on time, and keep close contact with our staff. CAREER DEVELOPMENT
1. Credit Internship: Alpine offers a college-credit internship program. Your Supervisors can produce a course syllabus if you are able to receive credit for your work with us. The program involves more than just executing projects and your supervisor will review the requirements with you before you agree to intern for credit. In addition, you are required to complete 20 hours per week for the duration of 16 weeks.

To ensure you get the most qualified Commercial Painting Contractor follow these simple steps.
Ask the right questions:


Company History is Important:How long have they been in business?
Has it been under the same name for that entire period of time? Are they members of the PDCA (Painting & Decoration Contractors of America) or the local Chamber of Commerce? Do they now or have they ever had any open cases with the Better Business Bureau or the Department of Labor? If so when and why?


Responsiveness:
When you called the office did someone answer the phone or did you have to leave a message? Can they provide you with a time and day of when to schedule your estimate or will someone have to get back to you? Will they provide you with email or their cell phone? Open communication is essential when working on larger projects.


Safety:

Lead Paint is Poison - Alpine Painting & Sandblasting Contractors are Certified Lead Abatement Contractors


POISONED PAINT

The use of lead-based paint has been banned for three decades. Yet more than 38 million homes in this country are estimated still to be contaminated with lead paint, which can cause significant health problems, particularly in children. Almost one million children under age six suffer from lead poisoning, which can cause permanent brain damage.

So how can you tell if your house or building has lead paint? How do you find a contractor who can safely eliminate the health risk? Can you afford it? Before planning your next maintenance project, you should know the answers to questions such as these.
To raise awareness of the health risk, the week of Oct. 19 is designated National Lead Poisoning Prevention Week by the U.S Centers for Disease Control and Prevention.
Lead paint was used commonly in homes before 1978, when the U.S. Consumer Product Safety Commission banned its use because of the health hazards.
Homeowners aren’t required to remove lead paint since it poses no immediate risk unless it is flaking or peeling. However, when lead paint is peeling or disturbed during renovations, it should be removed immediately, according to the U.S. Department of Housing and Urban Development (HUD).
Lead enters the body mainly though inhalation and ingestion. Signs of lead poisoning may include fatigue, sleep problems, irritability and headaches. Many of the symptoms are commonly misdiagnosed as the flu. Children and pregnant women have the greatest risk of permanent health damage. Lead dust settles on floors and walls where it can get on children’s hands or toys and into their mouths.

Testing Methods
There are three ways to test for lead in paint, but only one can be done by the homeowner. The other two require the use of professional testing services. The most common testing method is X-ray fluorescence (XRF) in which a handheld device is used to determine the presence and quantity of lead. XRF is the preferred method for residential work because many measurements can be taken in a short period of time with no damage to the surface being tested.
The second method is a paint chip analysis. Paint chips must be sent to a certified testing laboratory and analyzed for total lead content. Results from each of these methods should be compared to the acceptable ranges established by HUD and discussed with a certified industrial hygienist.
Homeowners can test using swabs that change color in the presence of paint containing lead. Lead-testing kits are sold at home improvement stores and on the Internet. While this test isn’t as accurate as the other two methods and can’t provide a quantitative analysis, it is an inexpensive way to determine whether it’s necessary to hire a professional testing service.
Homeowners shouldn’t try to remove lead paint themselves, the Consumer Product Safety Commission warns. It should be removed only by professionals trained to remove hazardous materials. Grinding, sanding or scraping can produce lead dust, which can be suspended in the air for some time. Once it lands on a surface, the area must be cleaned sufficiently or it may become contaminated. Typical contaminated areas include floors, window sills, window wells and the soil just outside the house. Since the dust can be airborne, the lead may contaminate your neighbor’s property or even public property. This can leave you vulnerable to lawsuits, which your insurance may not cover.

Treatment Choices
Once you determine you have lead-paint contamination, you have three options: abatement, encapsulation or repainting.
Abatement is the removal and disposal of all lead paint, with removal to the bare substrate. Typically, the work is done using a chemical stripper and power tools with a HEPA vacuum attachment. The work area should be sealed off with heavy plastic to contain the lead-contaminated waste and dust.
Encapsulation uses a specially approved coating applied to surfaces covered in lead paint. This product meets federal standards and is warranted by the manufacturer to seal the lead paint for at least 20 years. In most states, contractors must choose from state-approved encapsulants.
Repainting in a lead-safe manner is the most common and typically least expensive option. This can only be done before the state or municipality determines the lead paint is dangerous to the occupants. A contractor must protect the workers, the public and the environment from the dangers of the lead paint.
Cost is usually a key factor in deciding on the treatment. Abatement, or removal, is the most expensive treatment. It can cost three times as much as repainting, while encapsulation can cost double the amount. The higher cost is primarily due to the need to contain the area, collect dust, hire licensed contractors and workers with lead-pollution insurance and HEPA vacuum equipment.
Also, in deciding on a treatment, you should consider your liability if the job isn’t done correctly. For example, if your home is next to a playground or a daycare facility, your risk of contaminating a sensitive area is high. The chance of being sued may convince you to remove the hazard once and for all.
Your situation should be discussed with your contractor and a certified industrial hygienist so you can make an informed decision on how to proceed.

Hiring a Contractor
In choosing a qualified contractor to remove or treat lead paint, price should not be the only consideration. Some states require the use of licensed contractors, supervisors and workers to perform lead abatement and encapsulation. Some states set guidelines for repainting in a lead-safe manner. Contact your local health department for more information.
The U.S. Environmental Protection Agency is mandating stricter training for contractors and their workers beginning in 2010. Until then, look for a contractor who meets federal OSHA standards. Your contractor also should have lead pollution insurance and should name you as additional insured. Many general liability insurance policies exclude pollution from lead.
Make sure your contractor has a lead health and safety plan. This plan will prove to you that your contractor knows the hazards and is responsible in dealing with any problems that arise.
Finally, develop a written work plan to cover the details of the job. This should include methods for lead paint removal, dust suppression, worker protection and waste disposal.
Lead poisoning is more common than you may think. A recent episode on “Extreme Makeover: Home Edition” featured a foster family, who learned their children have lead poisoning. Dust from lead-based paint on the home’s exterior had deposited in the soil in their backyard, where the children play. It’s frightening to know that an invisible toxin could be harming you and your family.
